THEREON it is ORDERED that the motion is DENIED as moot.

See Doc. No. 106, The Clerk is directed to STRIKE (and return to the filer) Doc. No. 109, which appears to be the identical pleading.

MOTION: DEFENDANTS' MOTION TO COMPEL RANEY TO PRODUCE DOCUMENTS PREVIOUSLY WITHHELD AND TO UNDERGO MENTAL HEALTH EVALUATION AND TAKE PREVIOUSLY PRESCRIBED MEDICATION WITH MONITORING (Doc. No. 93)

THEREON it is ORDERED that the motion is DENIED.

To the extent the motion seeks to compel discovery, it is untimely and fails to comply with Local Rule 3.04(a). The certification of compliance with Local Rule 3.01(g) is also ambiguous at best.

To the extent Defendants seek an order from this Court compelling Plaintiff to undergo a mental health evaluation and take medication, their motion is misguided. This is not a criminal case, nor is it a guardianship case or a case involving involuntary commitment to a mental health facility under state law. To the extent Defendants base their motion on personal security and safety concerns, the proper avenue is through law enforcement departments, Defendants cite no authority for the proposition that a federal court in a civil suit may order a mental health evaluation and "monitoring" of a litigant, including ordering the litigant to take medication, on these circumstances. The motion is properly DENIED.
