Dear Mr. Sapp:

I received a message today confirming a meeting for Wednesday, April 1, 1998, at 11:00 a.m., at 14 Suntree Place, Suite 101, Viera. I will not be attending that meeting, as there has been some misunderstanding on my position regarding such a meeting.

In your letter dated, March 5, 1998, you proposed we meet in Melbourne to discuss discovery matters. I wrote to you on March 13, 1998, and requested that you call me to see if we could reach some kind of agreement on the disputed issues. I then received a phone call from your secretary trying to arrange a meeting on Tuesday, March 31, 1998. 1 told her that I was not available that date, and that I had requested in my letter you call me instead of meeting to discuss these issues. Your secretary informed me that you were going to be in Melbourne in any event to meet with your client, Meredith Raney. I told her that I may be available on Wednesday or Thursday, but wanted you to call me personally before I agreed to a meeting.

It is clear that there has been some misunderstanding. First, I wanted to speak with you before agreeing to a meeting, and second, I was not aware that the conference room in which you had previously met with Mr. Torpy was not located in our office. I do not intend to travel to Suntree to discuss a matter I believe can be resolved over the telephone.

I tried to call you this date but only reached your answering machine. Please call me regarding this matter. I should be in the office the remainder of today and all day Monday.
