Dear Mr. Lucas,

I enjoyed our telephone conversation earlier this afternoon. I understand that you will be supplying me with copies of the "affidavits" of the police officers and of my client which have been sent to the Court either as support for your motion for summary judgment or with some relation to that motion. At this point, I think that what are on file are probably neither affidavits nor depositions.

As far as the video tape which is filed with your motion for summary judgment, apparently no copy was supplied to me. When I sought to review your video tape which is in the Court's file, I was told by the Clerk's office that this was impossible because of the lack of equipment. As we discussed this afternoon, the only way that I can be sure that an accurate copy of the FACE violations has been furnished the Court is to send in a duplicate of what was furnished the Defendants, namely a repeat of some of thc educational material viewed by Mr. Raney coupled with thc three filmed episodes in question. With copy of this letter, my set of tapes is hereby forwarded to the Court for comparison.
