The Smith v. McDougall civil lawsuit, 99-385-CIV-FTM-21, was filed in Federal Court in the Middle District of Florida (Ft. Myers) on July 28, 1999.

STATEMENT BY ROBERT SMITH and RAY SIENKIEWICZ, plaintiffs

Recently, a Florida judge enjoined the enforcement of a new Florida law that would have required that the parents of a minor girl would have to be notified before an abortion could be performed on their minor daughter. This judge has therefore ruled that a minor girl can be legally dragged off to an abortion clinic for an abortion by the same sexual predator who got her pregnant in the first place - all without the knowledge of the girl's parents. We should be allowed to help.

We are pro-life counselors who volunteer our services to all persons at abortion clinics, including these victimized girls. We're their last hope to avoid coerced abortion and a lifetime of resulting problems.

We believe that Sheriff McDougall has unlawfully prevented us from offering love and help to the girls being brought to Ali Azima's abortuary. The Sheriff says that there has been a lot of pressure from Washington to put a stop to our counseling and referral program.

We have been offering love and help in a lawful manner. This is attracting attention from many in the pro-life movement. Our approach -- non-threatening, non-argumentative -- is intended to help each person as an individual. But what is good for a pregnant girl is not necessarily good for the abortion industry.

According to McDougall, powerful people in Washington want us stopped. Apparently he has agreed to help them. We are confident, though, that the constitution and civil rights laws, including FACE, will be fairly enforced in the Federal Courts. We will return to the doorway of Azima's abortuary as soon as possible.
